Terms of Use
These Terms of Use ("Terms") govern your use of the Mikata+ app ("the app"), provided by Mikata+ ("the operator", "we"). By downloading or using the app, you agree to these Terms. We have written them in plain language, but they are a real agreement between you and the operator.
1. About the app
Mikata+ is a coaching app for fitness beginners that suggests what to eat and what to do today. The app is free (no in-app purchases), and no sign-in is required. If you want backup or cross-device use, you may optionally sign in with your Apple or Google account (Section 4-2).
2. Who can use it (13+)
You must be at least 13 years old to use the app. Users under 13 cannot proceed past the birth date step in onboarding. If you are a minor, please use the app with the consent of a parent or guardian.
3. Not medical advice (important)
- The meal and workout plans, recipes, and figures such as calories and PFC balance provided by the app are general fitness information, not medical advice, diagnosis, or treatment. All numbers shown are approximate estimates.
- If you have a medical condition, are pregnant, are under a doctor's care, or have any health concerns, consult a doctor or other qualified professional before and while using the app.
- Listen to your body first. Make changes to exercise and diet gradually, and stop immediately if you feel unwell.
- The app's suggestions are not a substitute for individual guidance from professionals such as doctors, registered dietitians, or physical therapists.
- The meal plans, recipes, and foods suggested by the app do not determine or guarantee suitability for any allergy or dietary restriction (including those arising from a medical condition or religion). If you have an allergy or dietary restriction, always check the ingredient and allergen labelling on the product packaging yourself before eating. The ingredients and preparation of convenience-store and other products may change without notice.
4. Your data
4-1. Where your data is stored
- If you are not signed in, your data may be lost if you delete the app, change phones, or your device fails. We recommend enabling your OS backup (iCloud / Google Backup) or signing in for cloud backup, but the operator cannot guarantee the preservation of your data. Please keep your own record of anything important to you.
4-2. Sign-in (optional)
- Signing in is optional. You can use every feature of the app without it. Sign-in uses your Apple or Google account, and is offered so you can back up your data and use it across devices. The operator never handles your password.
- Eligibility: You may sign in only if you meet the conditions in Section 2 (13 or older, etc.).
- Your account: You are responsible for activity that occurs under your account. If you notice unauthorized use of your account, please contact the operator promptly.
- Deletion, reactivation, and termination: You may request deletion of your account and its associated data at any time. Account deletion is scheduled with a 6-month grace period, after which it is permanently deleted; within the grace period you can reactivate it. Deleting your account does not stop you from continuing to use the app with the data on your device. The operator may suspend or terminate an account, to a reasonable extent, in cases of a serious breach of these Terms, fraudulent or abusive use, or where required by law.
5. License to use the app
Subject to these Terms, the operator grants you a non-transferable, non-exclusive right to use the app for personal, non-commercial purposes. All intellectual property in the app and its content (design, illustrations, text, recipe and workout data, etc.) belongs to the operator or its rightful owners.
6. Acceptable use
When using the app, you must not:
- Reverse engineer, modify, copy, redistribute, or sell the app
- Use the app for unlawful purposes or in violation of applicable laws
- Interfere with the operation of the app or exploit vulnerabilities
- Present the app's content to others as if it were professional medical or nutritional advice
7. No warranty
The app is provided "as is". The operator makes no warranty of any kind, express or implied, that the app will operate without interruption or errors, that it is fit for a particular purpose, or that the figures it shows (calories, PFC, suggested amounts, etc.) are accurate.
8. Limitation of liability
- The operator is not liable for damages arising from your use of, or inability to use, the app, except in cases of the operator's willful misconduct or gross negligence.
- Even where the operator is liable, such liability is limited to the extent permitted by applicable law.
- Nothing in this section limits liability that cannot be excluded under applicable mandatory law, including consumer protection law. These Terms do not take away rights you are entitled to by law.
9. Changes to or termination of the app
The operator may change the app, or suspend or end its availability, without prior notice. Please understand that this is an app built by an individual developer. If the app is discontinued, we will make reasonable efforts to give advance notice.
10. Changes to these Terms
The operator may update these Terms when necessary. For significant changes, we will give notice in the app or on the store page. Continuing to use the app after a change means you accept the updated Terms. If you do not agree, please stop using the app and delete it.
11. Governing law and jurisdiction
These Terms are governed by the laws of Japan. Any dispute relating to the app shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance — without limiting any jurisdiction rights you have as a consumer under applicable law.
12. Streak shields
- 12.1 A "streak shield" (omamori) is an in-app item that protects your streak on a day you did not complete. 3 are granted free on the 1st of each month and are valid only within that month (they do not carry over).
- 12.2 By watching a video ad to the end, you can receive up to 3 more in the same month (6 in total). Watching is optional; every feature of the app is available whether or not you watch. Nothing is granted if you end the video early.
- 12.3 Streak shields may be used only to protect a streak inside this app, and cannot be exchanged for cash or anything else, transferred to a third party, or repurposed. The operator receives no payment for them.
- 12.4 A shield you have used cannot be undone. A day protected by a shield counts towards your streak, but is not counted as XP or as a "cleared day".
- 12.5 The number granted, the cap, and the mechanics may change. We will give notice before any change.
13. Ads
- 13.1 The app shows ads inside the app so its features can stay free to use. No ads are shown for the first 7 days after you start using the app, except a video you choose to play yourself to receive a shield, which is available during that period too.
- 13.2 Ad content is supplied by advertisers and by the ad-serving provider (Google); the operator is not responsible for that content or for the products and services advertised. Any dealings with an advertiser are between you and that advertiser.
- 13.3 The information sent from your device for ad serving, and the choices available to you, are as set out in Section 15 of the Privacy Policy.
